Welcome to Newport Beach Media, LLC ("Newport Beach Media"). Please read these Terms of Service ("Terms") carefully before using our Services.

By accessing or using Newport Beach Media's videography or photography services, or engaging in any form of communication with us, you agree to comply with and be bound by these Terms. If you do not agree with any part of these Terms, please refrain from using our services.

1. Services

We provide professional real estate photography services, including property videography, photography, virtual tours, and related visual content (collectively, the "Services"). Our Services are subject to availability and may vary based on location and package selection.

 

2. Booking and Payment

2.1. To book our Services, please contact us through our website or designated communication channels. A valid booking is confirmed upon receipt of payment or a mutually agreed-upon arrangement.

2.2. Payment for our Services is due in accordance with the Terms agreed upon during booking. We accept credit cards and bank transfers as valid forms of payment. Unless specified otherwise we require 50% payment to confirm your booking and the remaining 50% upon final delivery of our agreed upon Services. Once we are on-location shooting content the initial 50% payment is considered non-refundable.

3. Cancellation and Rescheduling

3.1. Cancellations must be made 2 business days before the scheduled appointment to receive a full refund. Cancellations made after this period may result in a partial refund or no refund, depending on the circumstances.

3.2. Rescheduling requests must be made 2 business days before the scheduled appointment. We will make reasonable efforts to accommodate rescheduling requests but cannot guarantee availability.

 

4. Ownership and Use of Content

4.1. All visual content created by Newport Beach Media as part of our Services, including video content, photographs, virtual tours, and related media, remains the intellectual property of Newport Beach Media.

4.2. Clients receive a limited, non-exclusive, non-transferable license to use the content for their marketing and promotional purposes related to the photographed property once payment is received in full. This license does not grant the right to sell, license, sublicense, or otherwise distribute the content to third parties without our explicit written consent.

 

5. Client Responsibilities

5.1. The client agrees to ensure the property is prepared for Services, this includes clean surfaces (e.g. floors, windows, countertops) and any special property features. Please note, we do not provide cleaning or staging services.

5.2. The client is responsible for obtaining any necessary permissions, clearances, or rights for us to photograph the property.

6. Limitation of Liability

6.1. Newport Beach Media is not responsible for any indirect, incidental, special, consequential, or punitive damages arising from the use of our Services.

6.2. In no event shall our liability exceed the amount paid by the client for the specific Services giving rise to the claim.

7. Modifications to Terms

7.1. We reserve the right to update, modify, or replace these Terms at any time.

8. Governing Law

8.1. These Terms are governed by and construed in accordance with the laws of California. Any disputes arising from these Terms shall be subject to the exclusive jurisdiction of the courts located in California. By using our Services, you acknowledge that you have read, understood, and agree to abide by these Terms of Service.
